If you own data, projections, or other content that appears in PuckLogic, and you want it credited differently, corrected, or removed, email legal@getpucklogic.com. You do not need a PuckLogic account to send a notice, and there is no form to fill in.

What to send

Send your notice to legal@getpucklogic.com. To act on it we need all of the following. This is what U.S. copyright law asks for.

  • Your signature. Typing your name at the end of the email is enough.
  • What the work is. If there are many works, a representative list is enough.
  • Where the material is on PuckLogic, with enough detail for us to find it.
  • Your name, address, telephone number, and email address.
  • A statement that you believe in good faith that the use is not authorized by the owner, its agent, or the law.
  • A statement that your information is accurate, and that under penalty of perjury you are the owner or are authorized to act for the owner.

If your notice is missing something, we tell you what we need.

What happens next

We read this inbox on business days.

  • We acknowledge your notice within 2 business days, at the address you wrote from.
  • If your notice is missing details, we ask you for them within 2 business days.
  • If your notice is complete, we remove or disable the material within 5 business days.
  • We tell you what we did and when we did it.
  • We keep a dated record of every notice and of every action we take on it.

Users who upload their own files

PuckLogic lets a user upload their own projection file for their own private account. If your notice concerns an uploaded file, say so. We then follow the steps in the next section.

If we remove a file you uploaded

This applies to a file a user uploaded to their own account.

We tell the user within 2 business days that we removed or disabled the file, and why. The user may send a counter-notice to legal@getpucklogic.com.

A counter-notice must include all of the following:

  • The user's signature.
  • The file we removed, and where it was before we removed it.
  • A statement, under penalty of perjury, that the user believes in good faith that we removed it by mistake or misidentified it.
  • The user's name, address, and telephone number.
  • A statement that the user accepts the jurisdiction of the U.S. Federal District Court for the district of that address. If the address is outside the United States, the user accepts the jurisdiction of any U.S. judicial district where PuckLogic may be found.
  • A statement that the user will accept service of process from the person who sent the notice.

What we do with a counter-notice:

  • We send a copy to the person who sent the original notice within 2 business days.
  • We restore the file between 10 and 14 business days after we receive the counter-notice. U.S. copyright law sets that window. We cannot make it shorter or longer.
  • We do not restore the file if the person who sent the notice first tells us that they filed a court action to stop the user from using it.

A warning to both sides. U.S. copyright law makes you liable for damages if you knowingly misrepresent that material infringes, or that we removed it by mistake.

Repeat infringers

We terminate accounts that infringe again and again. This is the rule we apply.

  • A strike is a complete notice that we acted on, and that the user did not answer with a successful counter-notice.
  • First strike: we remove the file and we warn the user.
  • Second strike: we turn off uploads for that account.
  • Third strike within 12 months: we terminate the account.
  • We can terminate an account at once in a blatant case.

A successful counter-notice is not a strike.

Notices under Canadian law

Canada uses notice-and-notice. Under that approach a host forwards a notice to the user instead of removing the material on receipt. We follow that approach for a notice sent to us under Canadian law.

  • Send the notice to legal@getpucklogic.com. State your name and address, the work, your interest in the copyright, where the material is, the infringement you claim, and the date and time of it.
  • Do not include a settlement offer, a demand for payment, or a request for personal information. Canadian law forbids those in a notice.
  • We forward your notice to the user as soon as we can, and we tell you that we forwarded it.
  • We keep records that identify the user for 6 months after we receive your notice. If you start proceedings and tell us before those 6 months end, we keep those records for 1 year from receipt.
  • We charge you nothing for this.
